Collect a debt through the sale of real property

Does the person against whom you have a claim own a real property unit and do you have a mortgage deed as security? If so, you can have it determined that your claim has a special preferential right in the real property unit. The real property unit is then attached and you can get paid by having it sold.

If you have a decision (verdict) stating that your claim has a special preferential right in a real property unit — the property is considered attached. You have the right to request that the real property unit be sold in order for you to get paid.

You must request that we sell the real property unit within two months of the decision becoming legally binding (no longer subject to appeal). If you do not, the real property unit is no longer considered attached.

You can then request attachment of the real property unit (enforcement) yourself based on the decision in order to have the real property unit sold.

We then sell the real property unit at a public auction (compulsory sale) and you get paid.

Special preferential rights in real property

In your application to be paid (order to pay), you can request that your claim is granted a special preferential right in a real property unit. You need to attach a copy of the mortgage deed and fill in details on

  • the real property unit
  • the basis of your claim
  • when the claim should have been paid.

You can also apply in court for your claim to have a special preferential right in the real property unit.

Do you not have a decision (verdict)? Then you can apply for an order to pay.

You want to get paid

Then the decision can no longer be appealed.

You need to include the following documents in original:

  • decision (verdict) or the judgment with a legal validity certificate, if such exists
  • proof of claim and mortgage deed or other mortgage instrument (mortgage deed does not need to be submitted if it is a digital mortgage deed and you are registered as a mortgage deed holder in the Mortgage Deed Register).

Apply for us to collect the debt

You can apply for us to collect the debt pursuant to a judgment or order (verdict) before it has become legally binding (no longer subject to appeal). However, we normally cannot implement the measure as long as the judgment or decision is subject to appeal.

Submit legal validity certificate

You must submit a legal validity certificate if you apply for our assistance in collecting a debt pursuant to a court judgment. The certificate shows that the judgment can no longer be appealed. You can also apply for enforcement in advance. In that case, you send us the certificate as soon as possible.

Contact the court that issued the judgment and request a legal validity certificate.

  2. afterwards via email or by post if the judgment has not yet become legally binding when you apply.
