If someone owes you money, we can help you establish the debt. This involves you making an application for a payment injunction.
You can use a payment injunction for the majority of debts owed to you by private individuals or businesses. This includes the purchase [sale?] of goods and services as well as money you have lent.
Bear in mind that your claim must be for money, and that the payment deadline must have passed.
You fill in the form Application for a Payment Injunction, or make the application via Mina Sidor (My Pages). It is important that you fill in all the personal data, otherwise you may have to add information later and the process will take longer.
You need to state your claim, and the grounds for it, clearly enough that the individual or entity you regard as owing you money will understand what you mean. For example: “Rental of private car with registration number XXX 001. The rental took place in September 2018 under an agreement reached on 1 May 2018.”
Sign your application and post the original. You cannot send your application by fax or email. If you apply via Mina Sidor you sign the application using e-ID.
Making the application costs SEK 300. You can request to have that expense reimbursed on your application. You can also include compensation for work by you or your representative, usually SEK 380.
We send a letter, an injunction, to the individual or entity you want to be paid by, the debtor. The letter includes an acknowledgement of service that the recipient has to sign and return to us. This is proof that the letter was received by the debtor.
In some cases you can deliver the payment injunction yourself. This is known as service by party.
The recipient of the letter can do one of the following:
Once the decision to issue a payment injunction has been made, the general rule is that we begin to recover the debt. This incurs a fee of SEK 600.
We always try to charge the fee to the debtor, but if we are unable to you will be sent an invoice.
